AI Act 2027: high-risk rules from 2 December 2027 and what was delayed
Contents · 9 chapters
SHORT ANSWER
In 2027 the main AI Act change is that the obligations for high-risk AI systems listed in Annex III, such as recruitment, creditworthiness and education, apply from 2 December 2027, after Regulation (EU) 2026/1744 moved them from 2 August 2026. By 2 August 2027, providers of general-purpose AI models placed on the market before 2 August 2025 must take the necessary steps to comply and each Member State must have an operational sandbox. Annex I products moved to 2 August 2028. The Article 5 prohibitions, Article 4 AI literacy, general-purpose AI rules and Article 50 transparency were not delayed, but generators placed on the market before 2 August 2026 have until 2 December 2026 to mark outputs.
The 2027 deadlines
| Date | Deadline and what happens | Who it concerns | Provision |
|---|---|---|---|
| 1 Aug 2027 | By this date the Commission publishes guidelines on aligning Article 8(2), Article 9(10) and Article 17(3) with the sector legislation in Section A of Annex I without duplication. | Commission, product manufacturers | Art. 96(1)(g) |
| 2 Aug 2027 | By this date providers of general-purpose AI models placed on the market before 2 Aug 2025 take the necessary steps to comply with the regulation. | Model providers | Art. 111(3) |
| 2 Aug 2027 | By this date each Member State must have at least one operational national AI regulatory sandbox. | Member States | Art. 57(1) |
| 2 Aug 2027 | By this date the Commission adopts delegated acts specifying the high-risk systems under Article 6(1) for which the requirements of Articles 9 to 15 and 17 to 25 may be limited, where the legislation in Section A of Annex I provides an equivalent or higher level of protection and the limitation does not reduce the overall level of protection under the regulation. | Commission | Art. 2(13) |
| 2 Sep 2027 | By this date the Commission adopts guidance, including a template, on the post-market monitoring plan. | Commission, providers | Art. 72(3) |
| 2 Dec 2027 | From this date Chapter III Sections 1, 2 and 3 apply to high-risk systems under Article 6(2) and Annex III. | Providers and deployers | Art. 113, third paragraph, point (c)(i) |
And two deadlines that follow:
| Date | Deadline and what happens | Provision |
|---|---|---|
| 2 Aug 2028 | From this date Chapter III Sections 1, 2 and 3 apply to high-risk systems under Article 6(1) and Annex I (for Section A), that is, AI in products. | Art. 113, third paragraph, point (c)(ii) |
| 2 Aug 2030 | By this date providers and deployers of high-risk systems intended for use by public authorities take the necessary steps to comply in any case, even if the systems were placed on the market earlier. | Art. 111(2) |
Annex III covers, among other areas, biometrics, critical infrastructure, education and vocational training, employment and workers’ management, and access to essential private and public services. For an ordinary company points 4 and 5 matter most: recruitment and selection, decisions on terms of work, monitoring and evaluating employee performance, creditworthiness of natural persons, and risk assessment and pricing in life and health insurance.
What the amendment delayed
| Obligation | Originally | After the amendment | Provision |
|---|---|---|---|
| High-risk systems under Annex III | 2 Aug 2026 | 2 Dec 2027 | Art. 113, third paragraph, point (c)(i) |
| High-risk systems under Annex I | 2 Aug 2027 | 2 Aug 2028 | Art. 113, third paragraph, point (c)(ii) |
| National AI regulatory sandbox | by 2 Aug 2026 | by 2 Aug 2027 | Art. 57(1) |
| Post-market monitoring template | implementing act by 2 Feb 2026 | guidance by 2 Sep 2027 | Art. 72(3) |
| Legacy high-risk systems | placed on the market before 2 Aug 2026 | placed on the market before the date of application of Chapter III | Art. 111(2) |
| Marking by legacy generators | from 2 Aug 2026 | by 2 Dec 2026 | Art. 111(4) |
Annex I Section A concerns AI in products covered by the Union harmonisation legislation listed in that section. For products under Section B, Article 2(2) applies only Article 6(1), Article 60a and Articles 102 to 112. Under Article 111(2), the regulation applies to operators of legacy high-risk systems, those placed on the market or put into service before the date of application of Chapter III, only if from that date their design changes significantly; recital 39 of the amendment looks to when the first unit of that type and model was placed on the market. Legacy generators are those placed on the market before 2 August 2026; under Article 111(4) they take the necessary steps to comply with Article 50(2), machine-readable marking of outputs, by 2 December 2026. The amendment did not change the deadline for general-purpose AI models placed on the market before 2 August 2025; it remains 2 August 2027, and providers take the necessary steps to comply by then (Article 111(3)).
What was not delayed
| Obligation | Applies from | Provision |
|---|---|---|
| Article 5 prohibitions | 2 Feb 2025 | Art. 113, third paragraph, point (a) |
| Article 4 AI literacy | 2 Feb 2025 | Art. 113, third paragraph, point (a) |
| General-purpose AI models and penalties | 2 Aug 2025 | Art. 113, third paragraph, point (b) |
| Article 50 transparency, except marking by legacy generators (until 2 Dec 2026) | 2 Aug 2026 | Art. 113, Art. 111(4) |
| New Article 5 prohibitions | 2 Dec 2026 | Art. 113, third paragraph, point (a), Art. 5(1), first subparagraph, points (ba) and (bb), Art. 5(1a) and (1b) |
Since 2 August 2025 the rules for providers of general-purpose AI models in Chapter V and the penalties in Chapter XII have applied, except Article 101. The new prohibitions cover non-consensual intimate deepfakes and child sexual abuse material; for systems and for their use they are conditional under Article 5(1a) and (1b). They are not a delay; the amendment added them to Article 5 with their own date of application. A company that reads the delay as a reason to leave the AI Act until the end of 2027 overlooks obligations that already apply.
Checklist for a company that deploys AI
Already applies
- Measures to support the AI literacy of staff and other persons using AI on your behalf. Article 4(1), as worded since 27 July 2026, does not require you to guarantee a specific level of AI literacy of any individual (Art. 4).
- A check that no tool is used for a prohibited practice (Art. 5).
- Informing people exposed to an emotion recognition or biometric categorisation system, if you use one (Art. 50(3)).
- Disclosing that a deep fake was artificially generated or manipulated, and the same for text published to inform the public on matters of public interest, unless the text underwent human review or editorial control with editorial responsibility (Art. 50(4)).
From 2 December 2027, if the provider intends the system for an Annex III use
- Check your inventory of AI tools against Annex III, especially points 4 and 5.
- Check whether you become the provider: if you put your name or trademark on a high-risk system already on the market or in service (without prejudice to contractual arrangements stipulating that the obligations are otherwise allocated), substantially modify it, or modify the intended purpose of an AI system, including a general-purpose AI system, which was not high-risk so that it becomes high-risk, you take on the provider obligations under Article 16 (Art. 25(1)).
- For systems placed on the market or put into service before 2 December 2027, check Article 111(2): the regulation applies to operators of such systems only if their design changes significantly, while for systems intended for use by public authorities providers and deployers take the necessary steps to comply by 2 August 2030.
- Obtain the instructions for use from the supplier and take measures to use the system in line with them (Art. 26(1)).
- Assign human oversight to people with the necessary competence, training and authority (Art. 26(2)).
- Where you control the input data, ensure it is relevant and sufficiently representative (Art. 26(4)).
- Monitor operation on the basis of the instructions. If you have reason to consider that use in accordance with the instructions may present a risk within the meaning of Article 79(1), inform the provider or distributor and the relevant market surveillance authority without undue delay and suspend use of the system. For a serious incident, inform immediately first the provider, then the importer or distributor and the relevant market surveillance authorities (Art. 26(5)).
- Keep the automatically generated logs under your control for at least six months (Art. 26(6)).
- As an employer, inform workers’ representatives and the affected workers before deployment (Art. 26(7)).
- If the system makes or assists decisions about people, inform them that they are subject to its use (Art. 26(11)).
- Prepare a fundamental rights impact assessment if you are a body governed by public law, a private entity providing public services, or you use a system for creditworthiness or for life and health insurance (Art. 27(1)).
- Use the provider’s information for your data protection impact assessment under Article 35 GDPR (Art. 26(9)).
Checklist for providers

Frequently asked questions
What changes in the AI Act in 2027?
From 2 December 2027, Chapter III Sections 1, 2 and 3 apply to high-risk AI systems classified under Article 6(2) and Annex III: classification, the requirements for the systems and the obligations of providers and deployers. By 2 August 2027, providers of general-purpose AI models placed on the market before 2 August 2025 must take the necessary steps to comply (Article 111(3)), and each Member State must have at least one operational national AI regulatory sandbox (Article 57(1)).
Was the AI Act delayed to 2027?
Only part of it. Regulation (EU) 2026/1744 moved the high-risk obligations for Annex III systems from 2 August 2026 to 2 December 2027 and for products under Annex I from 2 August 2027 to 2 August 2028. The Article 5 prohibitions and Article 4 AI literacy have applied since 2 February 2025, the rules for general-purpose AI models since 2 August 2025 and the Article 50 transparency rules since 2 August 2026.
Does 2 December 2027 matter for a company that only uses AI?
Yes, if the provider intends the AI system to be used in an Annex III area, for example to filter job applications, evaluate employee performance or assess the creditworthiness of natural persons (Article 3, points (4) and (12)). The company is then a deployer of a high-risk system and the Article 26 obligations apply to it from 2 December 2027 (Article 113, third paragraph, point (c)(i)), for older systems subject to Article 111(2), see the next answer. Under Article 25(1), a company is considered a provider if it puts its name or trademark on a high-risk system, without prejudice to contractual arrangements stipulating that the obligations are otherwise allocated, makes a substantial modification to it, or modifies the intended purpose of an AI system, including a general-purpose AI system, which has not been classified as high-risk, so that it becomes high-risk.
Does the regulation apply to high-risk systems a company already uses?
Article 111(2) provides that, without prejudice to Article 5, the regulation applies to operators of high-risk systems placed on the market or put into service before the date of application of Chapter III only if, as from that date, those systems are subject to significant changes in their design. According to recital 39 of Regulation (EU) 2026/1744, the decisive factor is the date on which the first unit of that type and model was placed on the market or put into service on the Union market for the first time. Under Article 113, third paragraph, point (c)(i), the date of application is 2 December 2027 for Annex III, and under point (c)(ii) 2 August 2028 for Annex I. For systems intended to be used by public authorities, providers and deployers shall in any case take the necessary steps to comply by 2 August 2030.
When must national AI regulatory sandboxes be ready?
Article 57(1) requires each Member State to ensure that its competent authorities establish at least one AI regulatory sandbox at national level, operational by 2 August 2027. The original deadline was 2 August 2026; Regulation (EU) 2026/1744 moved it.
